Terms and Conditions

PLEASE READ THESE TERMS OF SERVICE CAREFULLY, AS THEY CONTAIN IMPORTANT INFORMATION REGARDING YOUR LEGAL RIGHTS, REMEDIES, AND OBLIGATIONS. THESE INCLUDE VARIOUS LIMITATIONS AND EXCLUSIONS, A CLAUSE THAT GOVERNS THE JURISDICTION AND VENUE OF DISPUTES, AND OBLIGATIONS TO COMPLY WITH APPLICABLE LAWS AND REGULATIONS.

IN PARTICULAR, Travel Organizers (“Trip Organizers”) SHOULD UNDERSTAND HOW THE LAWS WORK IN THEIR RESPECTIVE DESTINATION COUNTRIES. CERTAIN COUNTRIES HAVE RESTRICTIONS ON TRAVEL GUIDES, TRAVEL COMPANIES, AND OTHER TRAVEL ORGANIZERS OR REQUIRE TRAVEL GUIDES, TRAVEL COMPANIES, AND OTHER TRAVEL ORGANIZERS TO HAVE PERMITS. TRIP ORGANIZERS SHOULD REVIEW LOCAL LAWS BEFORE LISTING A TRIP ON TRUE STRIVE AND USING TRUE STRIVE TO COLLECT PAYMENTS.

True Strive LLC dba True Strive is a specialized tour operator offering unique tours of Vietnam that showcase the country’s compelling history, beautiful landscape, and fresh culinary experiences and immerse you in its rich culture. The terms “we,” “us,” “our,” and “True Strive” refer to True Strive LLC, a Nevada Limited Liability Company. The term maintains the website ("Site") located at www.truestrive.org, including any other truestrive.org branded websites owned and controlled by us as a service to our users and visitors. Our Site and the services we offer, both through the Site and otherwise, are referred to collectively as our "Services." By using the Services, you agree to comply with and be legally bound by the following terms of use ("Terms"), whether or not you become a registered user of the Services ("Member," which may include either a "Trip Organizer," a "Traveler" and other visitors and browsers of the Services). Please review the following terms carefully. If you do not agree to these terms, you have no right to obtain information from the Site or continue using the Services. Failure to use the Services by the following terms of use may subject you to civil and criminal penalties.

In addition, when using certain features of the Services, you also will be subject to the guidelines, terms, and agreements applicable to such features ("Policies"). All such Policies are incorporated by reference into these Terms. If these Terms are inconsistent with any Policy, the Terms will control.

We reserve the right to modify the Services, these Terms, and/or Policies at any time. If we modify these Terms, we will post the modification on the Site or via the Application and/or email you to notify you of the modification. Changes to the Terms will be effective at the time of posting.

You are responsible for regularly reviewing these Terms. By using the Services, you agree that posting new or revised Terms or Policies on the Site will constitute adequate and constructive notice to you of any revisions and changes. Continued use of the Services after any such changes or after explicitly accepting the new terms upon logging into the Site shall constitute your consent to such changes, and you agree to be bound by them as of the modification date.

“you,” “traveler,” “participant,” or “guest” refers to the traveler making a booking with us and all members of their group.

SERVICES. 

Truestrive.org is designed to help travel-interested customers ("Travelers") connect to travel-related services provided by other members (which may include "Trip Organizers"). Services may consist of various travel services offered by Trip Organizers. Trip Organizers may collect payments and manage bookings for travel services through the services. Trip Organizers may create and post personal profiles ("Profiles") that provide information about the Trip Organizers' knowledge and experience and may make themselves available to offer specific services to Travelers, such as participation in a travel service ("Trip") offered by the Trip Organizers. Travelers may select Trip Organizers to provide the Traveler with a travel service.

ELIGIBILITY. The Site and Services are intended solely for persons 18 or older. Any access to or use of the Site or Services by anyone under 18 is prohibited. By accessing or using the Site or Services, you represent and warrant that you are 18 or older.

USER RESPONSIBILITIES. Our site is an online platform and marketplace that uses related technology. Members can offer travel services, collect payments for travel services, and find and learn about travel services other members provide. Travelers and trip organizers can learn about each other through the services and arrange for trip bookings directly with each other. Wetravel is not the organizer, operator, or provider of any travel-related activities, including, but not limited to, tours, trips, and activities. Unless explicitly specified otherwise in the Wetravel platform, Wetravel's responsibilities are limited to (i) facilitating the availability of the Site and Services and (ii) serving as the limited payment collection agent of each Trip Organizer to accept payments from Travelers on behalf of the Trip Organizer.

PLEASE NOTE THAT, AS STATED ABOVE, THE SITE AND SERVICES ARE INTENDED TO BE USED TO FACILITATE TRIP ORGANIZERS AND TRAVELERS CONNECTING AND BOOKING TRIPS DIRECTLY WITH EACH OTHER. TRUE STRIVE CANNOT AND DOES NOT CONTROL THE CONTENT CONTAINED IN ANY TRIP OFFERING AND THE CONDITION, CIRCUMSTANCES, LEGALITY, OR SUITABILITY OF ANY TRIP. TRUE STRIVE IS NOT RESPONSIBLE FOR AND DISCLAIMS ANY AND ALL LIABILITY RELATED TO ANY AND ALL LISTINGS AND TRIPS. ACCORDINGLY, ANY BOOKINGS WILL BE MADE AT THE TRAVELER'S OWN RISK.

CONTRACT. We draw your attention to the terms and conditions of travel below. These terms and conditions, including all brochures, documents, correspondence, and the terms and conditions of our Suppliers, form the basis of the contract with you (collectively, “Terms and Conditions”).  Before booking with us, you must ensure that you have read and understood these Terms and Conditions (and ask any questions you may have). Please be aware that these Terms and Conditions contain waivers of liability and waiver of class action, venue selection, and notice clauses. By asking us to confirm your booking, you are accepting all of the Terms and Conditions laid out below and acknowledging that you have read and agree with the Terms and Conditions of this legally binding agreement. If you do not agree with any part of these Terms and Conditions, you must not make a booking with us or pay us in connection with our travel-related services.

 

If you are making a booking as a group, the leader is responsible for sharing these Terms and Conditions with all group members and is financially responsible for the booking. We will not be liable for a group leader’s failure to share these Terms and Conditions with all travelers in their group.

 

You represent and warrant that (a) you are of sufficient age to use our services and website and can create binding legal obligations in connection with your use, (b) you are legally authorized to act on behalf of those you represent and accept these Terms and Conditions on their behalf, and (c) the information supplied by you or members of your group is true and correct.

ACCOUNT REGISTRATION. To access certain features of the Site, book a trip, or create a Listing, you must register to create an account ("TRUE STRIVE Account") and become a Member ("Member"). You may register to join the Services directly via the Site or as described in this section.

You can also register to join by logging into your account with specific third-party social networking sites ("SNS") (including, but not limited to, Facebook and Google; each such account, a "Third-Party Account") via our Site, as described below. As part of the functionality of the Site and Services, you may link your Wetravel Account with Third-Party Accounts by either (i) providing your Third-Party Account login information to Wetravel through the Site and Services or (ii) allowing TRUE STRIVE to access your Third-Party Account, as permitted under the applicable terms and conditions that govern your use of each Third-Party Account. You represent that you are entitled to disclose your Third-Party Account login information to TRUE STRIVE and/or grant TRUE STRIVE access to your Third-Party Account (including, but not limited to, for use for the purposes described herein) without breach by you of any of the terms and conditions that govern your use of the applicable Third-Party Account and without obligating TRUE STRIVE to pay any fees or making TRUE STRIVE subject to any usage limitations imposed by such third-party service providers. By granting TRUE STRIVE access to any Third-Party Accounts, you understand that TRUE STRIVE will access, make available, and store (if applicable) any Content that you have provided to and stored in your Third-Party Account ("SNS Content") so that it is available on and through the Site and Services via your TRUE STRIVE Account and TRUE STRIVE Account profile page. Unless otherwise specified in these Terms, all SNS Content, if any, will be considered Member Content for all purposes. Depending on the Third-Party Accounts you choose and subject to the privacy settings set in such Third-Party Accounts, personally identifiable information you post to your Third-Party Accounts will be available on and through your TRUE STRIVE Account on the Site and Services. Please note that if a Third-Party Account or associated service becomes unavailable or TRUE STRIVE's access to such Third-Party Account is terminated by the third-party service provider, then SNS Content will no longer be available on and through the Site and Services. You have the ability to disable the connection between your TRUE STRIVE Account and your Third-Party Accounts at any time by contacting TRUE STRIVE.

 

PLEASE NOTE THAT YOUR RELATIONSHIP WITH THE THIRD-PARTY SERVICE PROVIDERS ASSOCIATED WITH YOUR THIRD-PARTY ACCOUNTS IS GOVERNED SOLELY BY YOUR AGREEMENT(S) WITH SUCH THIRD-PARTY SERVICE PROVIDERS. TRUE STRIVE makes no effort to review any SNS Content for any purpose, including but not limited to accuracy, legality, or non-infringement, and TRUE STRIVE is not responsible for any SNS Content.

Your TRUE STRIVE Account and TRUE STRIVE Account profile page will be created for your use of the Site and Application based upon the personal information you provide or that we obtain via an SNS as described above. You may not have more than one (1) active TRUE STRIVE Account. You agree to provide accurate, current, and complete information during the registration process and to update such information to keep it accurate, current, and complete. TRUE STRIVE reserves the right to suspend or terminate your TRUE STRIVE Account and your access to the Site, Application, and Services if you create more than one (1) TRUE STRIVE Account if you have not made or collected payment through TRUE STRIVE in the last twelve (12) months or if any information provided during the registration process or thereafter proves to be inaccurate, fraudulent, not current, incomplete, or otherwise in violation of these Terms of Service.

You are responsible for safeguarding your password and agree not to disclose it to any third party. Unless expressly authorized by a specific feature on TRUE STRIVE, you are not permitted to share your TRUE STRIVE Account with anyone or allow others to access or use your TRUE STRIVE Account.

VIOLATIONS BY YOU. You agree that any breach of any such Terms and Conditions may result in (a) the cancellation of your reservation or purchase, (b) your forfeiture of any monies paid for your reservation or purchase, and (c) your being denied access to the applicable travel related product or service.

 

CHANGES TO THESE TERMS AND CONDITIONS. True Strive reserves the right, in our sole discretion, to change these Terms and Conditions at any time. Updated versions of the Terms and Conditions will be posted here on this website and are effective immediately upon posting. If we make material changes, we will notify you. Please check frequently before booking to see if these Terms and Conditions changed. Your continued use of our services, including continuing to use or maintain any bookings after any changes to the Terms and Conditions, constitutes your consent to the changes.

 

SCOPE/AGENCY. True Strive does not provide, own, manage, operate, supervise, or control the travel services and products that may be provided as part of your trip, such as eateries, trains, rental cars, touring cars, flights, accommodations (e.g., hotels), cruise, packages, or travel insurance (the “Travel Products”). All Travel Products are owned, controlled, operated, or made available by vetted, independent third parties such as destination management companies, airlines, hotels, cruise lines, and tour operators (the “Suppliers”). The Suppliers are solely responsible for the Travel Products and any and all benefits, perks, or amenities, including, without limitation, resort credits, onboard credits, free specialty dining, spa credits, in-room amenities, etc. The Supplier’s terms, conditions, and privacy policies apply to your booking, so you must agree to and understand those terms. Your interaction with any Supplier is at your own risk; True Strive does not bear any responsibility should anything go wrong with your booking or during your travel. Hence, as the traveler, you agree that True Strive acts only as an agent for the traveler in acquiring transportation, hotel accommodations, cruises, sightseeing, and other Travel Products, privileges, or services for the traveler’s benefit and on the express condition that True Strive shall not be responsible for any act, omission, negligence, bankruptcy, insolvency or default of any Supplier, company or person engaged in or responsible for any Travel Products, or otherwise in connection therewith.

 

Please carefully and promptly review all documents, including the cancellation policies and terms and conditions of the Suppliers. We will not be responsible for any errors. You are responsible for reviewing all travel documentation and alerting us of any corrections as soon as possible.    

NO ENDORSEMENT.

TRUE STRIVE does not endorse any travel organizer, traveler, or trip. These Terms require members to provide accurate information. Although TRUE STRIVE may undertake additional checks and processes designed to help verify or check the identities or backgrounds of users, we do not make any representations about, confirm, or endorse any Member or the Member’s purported identity or background.

Any references in the Site or Services to a Member being “verified” or “connected” (or similar language) only indicate that the Member has completed a relevant verification process and does not represent anything else. Any such description is not an endorsement, certification, or guarantee by TRUE STRIVE about any Member, including the Member’s identity and whether the Member is trustworthy, safe, or suitable. Instead, any such description is intended to be helpful information for you to evaluate when you make your own decisions about the identity and suitability of others you contact via the Site and Services. TRUE STRIVE is not responsible for any damage or harm from your interactions with other Members.

By using the Site or Services, you agree that any legal remedy or liability you seek to obtain for actions or omissions of other Members or third parties will be limited to a claim against the particular Members or other third parties who caused you harm. You agree not to attempt to impose liability on or seek any legal remedy from TRUE STRIVE concerning such actions or omissions. This limitation shall not apply to any claim by a Trip Organizer against TRUE STRIVE regarding the remittance of Traveler payments by TRUE STRIVE on behalf of a Trip Organizer, which instead shall be subject to the limitations described in the section below entitled “Limitation of Liability.”

 

BOOKING/PAYMENT.  When you are ready to start your next travel adventure, simply contact us by email or phone or by filling out the contact information on the website at https://www.truestrive.org/travelservices. Our itineraries take many hours of planning and work to create the unique experience we aim to give our travelers. Booking will be confirmed on receipt of the completed registration form and payment of your applicable deposit. After booking is processed, you will receive your final itinerary (subject to change as described herein), an invoice with payment information, and other important travel information. The invoice will contain a breakdown of the elements of your booking. Some Suppliers will require a larger deposit, or payment in full, to hold your booking. Travelers will be notified if a larger deposit is required. Deposits and fees are NON-REFUNDABLE unless stated otherwise in the Supplier's Terms & Conditions.  

 

Our bookings do NOT include airfare to your arrival or from your departure destinations. Inter-tour airfare is only included as expressly described in your itinerary. You must not make any air reservation until you receive your booking confirmation. Your contract for airfare is with the carrier and subject to its terms, conditions, and policies, and we will not be liable for any change fees, cancellation fees, or other additional costs you incur with the air carrier.

 

Upon booking, we will provide instructions for payments and all due dates.  You must make all payments in full and on time.  If you are booking within 60 days of departure, full payment will be due at the time of booking confirmation. If full payment is not received 60 days before departure, we reserve the right to cancel your travel and apply the cancellation charges in the cancellation section below. Failure to make a payment may result in the cancellation of your trip.  In such a case, consider this a cancellation, and the cancellation terms and fees as described below would be in effect.

 

As our tours are carefully curated experiences for groups of participants, you cannot request or make changes to your finalized itinerary.

Bookings and Financial Terms for Travelers

The Trip Organizers, not TRUE STRIVE, are solely responsible for honoring any confirmed booking and making available the proposed travel services reserved through the Site and Services. Suppose you, as a Traveler, enter into a transaction with a Trip Organizer to book a trip. In that case, you agree and understand that you will be required to enter into an agreement with the Trip Organizer. You agree to accept any terms, conditions, rules, and restrictions associated with such a Trip imposed by the Trip Organizer. You acknowledge and agree that you, and not TRUE STRIVE, will be responsible for performing the obligations of any such agreements, that TRUE STRIVE is not a party to such agreements, and that, with the exception of its payment obligations hereunder, TRUE STRIVE disclaims all liability arising from or related to any such agreements. You acknowledge and agree that, notwithstanding the fact that TRUE STRIVE is not a party to the agreement between you and Travel, TRUE STRIVE acts as the Trip Organizer's payment collection agent for the limited purpose of accepting payments from you on behalf of the Trip Organizer. Upon your payment of the Total Fees to TRUE STRIVE, your payment obligation to the Trip Organizer for the Trip Cost is extinguished. TRUE STRIVE is responsible for remitting the Trip Cost (less the TRUE STRIVE Fees and any Taxes in respect of the TRUE STRIVE Fees, such as VAT in Europe) in the manner described in these Terms. The total Trip Cost payable will be displayed to a Traveler at the time of payment. Suppose a booking is canceled and refunded by the Trip Organizer. In that case, any amounts collected by TRUE STRIVE will be refunded to such Traveler, depending on the Traveler's selections via the Site and Services and the applicable cancelation policy.

As a Traveler, you agree to pay TRUE STRIVE for the total Trip Cost for any booking requested in connection with your TRUE STRIVE Account if the applicable Trip Organizer confirms such requested bookings. To establish a, you understand and agree that TRUE STRIVE, on behalf of the Trip Organizer, reserves the right, in its sole discretion, to (i) obtain a pre-authorization via your credit card for the Total Trip Cost or (ii) charge your credit card a nominal amount, not to exceed one dollar ($1), or a similar sum in the currency in which you are transacting (e.g. one euro or one British pound), to verify your credit card. Once TRUE STRIVE receives confirmation of your booking from the applicable Trip Organizer, TRUE STRIVE will collect the Total Trip Cost in accordance with these Terms and the pricing terms outlined in the relevant Listing. Please note that TRUE STRIVE cannot control any fees charged to a Traveler by his or her bank related to TRUE STRIVE’s collectiSTRIVE'se Total Fees, and TRUE STRIVE disclaims all liability in this regard.

Regarding your requested booking, you will be asked to provide customary billing information such as name, billing address, and credit card or bank account information to TRUE STRIVE or its third-party payment processor(s). You agree to pay TRUE STRIVE for any confirmed bookings made in connection with your TRUE STRIVE Account in accordance with these Terms by one of the methods described on the Site, e.g., by PayPal, bank account, or credit card. You hereby authorize the collection of such amounts by charging the bank account or credit card provided as part of requesting the booking, either directly by TRUE STRIVE or indirectly, via a third-party online payment processor or by one of the payment methods described on the Site.

Suppose you are directed to TRUE STRIVE’s third-party paymenSTRIVE'ssor(s). In that case, you may be subject to terms and conditions governing the use of that third party’s service and that third party’s protocol collection practices. Please review such terms and conditions and privacy policy before using the services. Once your confirmed booking transaction is complete, you will receive a confirmation email summarizing your confirmed booking.

 

TRAVELER INFORMATION. While we do not assist with air reservations, we highlight the importance of accuracy. You can use our self-service to seek affordable air tickets here at https://truestrive.inteletravel.com. Names provided to secure reservations must match travelers’ passports. Any minor name corrections advised after issuing airline tickets will incur fees. Not all name corrections will be permitted by airlines and may require the purchase of a new ticket. Travelers voluntarily assume complete and sole responsibility for any and all risks and/or costs involved with failure to report any errors and/or omissions to documentation. Please review documents carefully and promptly; we will not be responsible for errors. It is your responsibility to review all travel documentation and alert us as soon as possible with any corrections. 

 

CREDIT CARD BOOKINGS. While we accept major credit cards, including Visa, Mastercard, American Express, and Discover (as well as payment via PayPal or check), travelers must provide us a click (checkbox) or signed authorization for every transaction for your trip. Your authorization is an agreement for us to charge your card and an acknowledgment and agreement to these Terms and Conditions, including the cancellation terms. As such, you agree not to make any improper chargebacks. 

 

In some instances, you have the ability to dispute charges with credit card companies ("chargebacks"). Before initiating a chargeback, we ask you to call us first to discuss any questions or concerns about our charges. We will work with you to attempt to resolve your concerns. By using our service to make a reservation, you accept and agree to our cancellation policy. True Strive retains the right to dispute any improper chargeback and recover any costs, including attorney’s fees related to improper chargebacks. Additionally, in the event of an improper chargeback, we retain the right to cancel any travel reservation related to that improper chargeback. The following chargeback scenarios are inappropriate, and we maintain the right to investigate and rebut any such chargeback claims:

  • Chargebacks resulting from non-cancellable reservations, whether or not the reservation is used.

  • Chargebacks result from charges authorized by family, friends, associates, or other third parties with direct access to your credit card. They do not include credit card fraud.

  • Chargebacks arising from inconsistency or inaccuracy with regard to the Supplier’s product description.

  • Chargebacks result from force majeure or other circumstances beyond True Strive's or the Supplier's control.

  • Chargebacks result from not agreeing with the cancellation policy.

 

PRICE AND RATE CHANGES.  The price of your itinerary will be based on known costs at the date of issue of the itinerary. All prices we advertise are accurate at the date published, but we reserve the right to change any of those prices occasionally. Prices include a cost for local taxes estimated at the publication date. When booking confirmation, we will provide an invoice reflecting the current price.

 

However, we reserve the right to add a supplement to your travel prices should our costs of supplying your travel increase until we receive your final payment. Any increase to your travel price will result from circumstances outside of our control, including, without limitation, changes in our costs of supplying your travel resulting from changes by our Suppliers, dues or taxes payable locally, currency fluctuations, and government action. If our costs to supply your travel increase, we reserve the right to increase the price of your travel and will forward a new Invoice reflecting any changes made. After the final payment, your price is locked in. We also reserve the right to change and correct advertised price errors at any time before your travel is confirmed.  We will advise you of any errors of which we are aware and of the then applicable price at the time of booking.

SERVICE FEES. In consideration of the use of TRUE STRIVE’s online marketplace and platform, TRUE STRIVE may charge marketplace service and payment processing fees (“Service Fees”). Where applicable, Taxes (such as VAT in Europe) may also be charged in respect of the Service Fee. TRUE STRIVE deducts the Trip Service Fees from the Trip Cost before remitting the balance to the Trip Organizer as described in these Terms. Balances will be remitted by TRUE STRIVE to Trip Organizers via advanced payments to third-party service providers, check, wire transfer, PayPal, direct deposit, or other payment methods described on the Site, in the Trip Organizer’s currency of choice, depending upon the selections the Trip Organizer makes via the Site and Services. Amounts may be rounded up or down as described in the “Rounding Off” section below.

Please note that TRUE STRIVE may impose or deduct foreign currency processing costs on or from any payments or payouts by TRUE STRIVE in currencies other than U.S. dollars. Except as otherwise provided herein, Service Fees are non-refundable.

 

What’s Included In Your Trip

Accommodations. 

Your itinerary details accommodations. Special requests, such as single rooms, lower floors, connecting rooms, and smoking preferences, must be made at the time of booking (as they may not be available and might incur an additional cost). While we will make reasonable efforts to communicate your requests to the Supplier, such requests are not guaranteed and are at the Supplier's discretion. There may be additional charges for such requests, which will be solely the expense of the guest making the request.

 

Travelers participating in our international tours should know that room sizes, standards, and facilities can vary regionally and often differ from those in the United States. This can include differences in bed and room sizes, bathroom amenities, air conditioning, and compliance with other standards such as the American Disabilities Act (ADA) and wheelchair accessibility. One of the joys of international travel is experiencing different cultures and ways of life, so we hope you will accept these differences with grace and a sense of adventure.

 

True Strive reserves the right, if necessary, to substitute other similar accommodations for accommodations listed on your itinerary. Such substitutions may be made at any time and without prior notice. We cannot be held responsible for over-bookings; should such occur, we will undertake to find similar accommodations in the same area. Such substitutions are at True Strive’s sole discretion, and no refunds will be offered for changes in accommodations.

 

While we exercise due diligence in selecting our partners, and several are based on our personal experiences, some hotel and other accommodation profiles are based on information provided by the Supplier.  This includes images and descriptions of the properties and rooms.  Additionally, travelers should be aware that star ratings or similar systems are based on country classifications and can differ.  While True Strive does its best to maintain current and accurate information regarding these Suppliers, we cannot be held responsible for any inaccuracies in Supplier descriptions, amenities, or images.

 

Transfers. True Strive is pleased to offer mid-tour transfers strictly in accordance with your individual itinerary, subject to additional fees as described in said itinerary. Except as expressly provided in your itinerary, you are solely responsible for transfers to and from airports and all other locations/destinations. You must be on time for all transportation. There will be no refund for missed or unused transfers.  If applicable, you must provide us with your flight information no less than 21 days before departure to ensure transfers will be available.  If at any time your flight plans change, you must notify us immediately.  Failure to do so may result in missing these services, and no refund shall be due for missed arrival transfers resulting from missing or outdated flight information. 

 

Meals. Meals (including street food) are included as expressly indicated in the itineraries. Any food and beverages consumed outside itinerary meals are not included and are at the guest's sole expense. For safety and liability reasons, True Strive and its Representatives cannot be responsible for directly accommodating any food allergies or dietary requirements and restrictions and are not responsible for any issues or problems associated with the same. We will advise our Suppliers of your request, but we cannot guarantee their availability. If you have a severe food allergy, we recommend contacting us regarding our private tours. 

 

Sightseeing/Activities

Sightseeing trips and activities are included as provided in the individual itineraries. Any excursions or activities not included in itineraries and done outside of tour times are at the sole expense of the traveler.  These trips and activities are designed to accommodate group travel. As a courtesy to others in the trip and/or activity, it is mandatory that you be on time for all scheduled experiences. Trips and activities will begin on time, and failure to arrive will be considered a no-show for which no refunds will be available. It is essential that you keep in mind that trip and activity times are set to accommodate climate, crowd size, and the best viewing options for our groups. Early morning departure times help create a better experience. Therefore, late arrivals cannot be accommodated.  

 

Changes to Itineraries

True Strive reserves the right to make changes to its published itineraries, which we deem insignificant due to reasons beyond our control. In such cases, we will arrange for the substitution of comparable services. 

 

While no changes are anticipated, there may be occasions when specific alterations become necessary. These can be due to religious holidays, national celebrations, or unforeseen events, including weather, governmental closures, acts of God, or any other reason. True Strive reserves the right to change the itinerary due to unforeseen circumstances or emergencies. Additionally, historic sites undergo renovations from time to time, which can obscure viewing or otherwise change the nature of visiting these sites. No trips will be canceled due to renovations, although True Strive may choose to amend itineraries for such sites. These changes will not be considered a material change or cause for cancellation by the guest.  

 

If we suggest alternate activities in place of a planned stop or in case of leisure time, such suggestions do not constitute our endorsement.  In such a case, you will be subject to the terms and conditions of the Supplier of the activity, and your only recourse in case of damage will be against the Supplier of the alternate activity.

 

What’s Not Included

Any items and matters not referred to in your itinerary are not included in the trip price. This can include but is not limited to items such as flights and airfare (international or domestic), any transportation not specified in your itinerary, checked and/or excess baggage; passport and visa fees; trip protection and/or insurances of all kinds; any donations, gratuities, and tips if not listed on your itinerary; laundry; phone calls; minibar; beverages and meals not detailed in the itinerary; optional experiences; and all items of a personal nature. Foreign governmental and non-governmental entities may collect additional taxes and surcharges. The price does not cover costs and expenses, including your return home, if you leave the guided holiday/vacation, whether of your own volition, our decision based on behavior that disrupts the trip due to illness, action by any government, or other reason. This list is illustrative and not a complete list of every item not included.

 

Non-Operation of Group Trips

Some trips are based on a minimum number of participants. True Strive makes every effort to ensure that trips meet their minimum requirements. However, if the trip drops below the minimum number of participants, cancellation of the trip may occur at the sole discretion of True Strive. In such cases, guests will be advised at least 30 days before departure. True Strive reserves the right to change the departure date. We may offer alternative trip dates or other travel arrangements. You may choose to accept these arrangements or to cancel your booking, in which case a full refund will be provided.  Any air cancellation will be in accordance with the carrier's terms, and True Strive will not be liable for the carrier’s refusal to issue any refund whatsoever.  In such case, True Strive will not be liable for any additional costs incurred outside of the trip prices, such as visa and passport fees, travel insurance, or any other purchases the guest makes in anticipation of the trip.

 

CancellationsIf you are unable to complete the tour due to a physical or mental inability to keep up with the group of participants, there shall be NO refunds owed even if you are unable to complete the tour.

 

As described above, True Strive is required to pay all Suppliers well in advance of your trip date. This includes but is not limited to hotel accommodations, meals, show tickets, admission tickets, transportation, etc. All suppliers have their cancellation policies, which apply to your booking. Should a cancellation become necessary, please inform True Strive immediately in writing and request a written confirmation of your cancellation. Upon receipt, True Strive will follow industry procedures for any applicable refunds as outlined in the Supplier’s terms and subject to their review. If you are entitled to a refund, please note that the Supplier is responsible for this refund, not True Strive. Suppliers may choose to provide a travel voucher or credit in lieu of a refund. We are not responsible for a Supplier’s failure to pay a refund or for a Supplier's bankruptcy or insolvency.

 

In addition, cancellation charges will apply. Cancellation charges are expressed at a percentage of the quoted price as follows:

If the reason for cancellation is covered under the terms of your travel protection plan, you may be able to reclaim these charges; for this reason, we strongly encourage the purchase of a travel protection plan, including additional Cancel For Any Reason coverage. The air carriers’ terms govern airline tickets, and we are not responsible for any air carrier’s refund decision.

If, as a Traveler, you wish to cancel a confirmed booking made via the Site and Services, either prior to or during the Trip, the cancellation policy of TRUE STRIVE or, if specified differently contained in the applicable Listing, the cancellation policy of the Listing will apply to such cancellation. Our ability to refund the Trip Costs and other amounts charged to you will depend upon the terms of the applicable cancellation policy. Details regarding refunds and cancellation policies are available via the Site or by contacting the Trip Organizer. The Service Fee is non-refundable regardless of the cancellation policy of the Trip Organizer.

If a Trip Organizer cancels a confirmed booking made via the Site and Services, (i) TRUE STRIVE will refund the Total Fees for such booking to the applicable Traveler within a commercially reasonable time of the cancellation, and (ii) the Traveler will receive an email or other communication from TRUE STRIVE that may contain alternative travel services and other related information.

If, as a Trip Organizer, you cancel a confirmed booking, TRUE STRIVE may apply penalties or consequences to you or your past, current and future listings.

In certain circumstances, TRUE STRIVE may decide, in its sole discretion, that it is necessary or desirable to cancel a confirmed booking made via the Site and Services. TRUE STRIVE may also determine, in its sole discretion, to refund to the Traveler part or all of the amounts charged to the Traveler. Reasons for such refunding to Travelers include but are not limited to, the Trip Organizer’s inaccurate description of the services rendered or failure to render services.

Cancellation or Changes by True Strive

 

Suppose circumstances require changes between planning time and/or during actual travel. In that case, True Strive and its Suppliers reserve the right to cancel or vary any itinerary and substitute components of any trip, including but not limited to hotels and accommodations of comparable quality if air schedule or surface transportation charges, security matters, and/or other events make such alterations necessary. Suppliers may substitute transportation equipment depending on various factors, including the volume of passengers on the trip. Sightseeing trips may be altered as described above. True Strive cannot be held responsible for any closures, necessary itinerary changes, or curtails for any reason. These changes will not be considered material changes or cause for cancellation by the traveler. Normal cancellation penalties still apply to the trip that has been changed. Without limitation to the foregoing, we reserve the right to cancel or reschedule any trip departure for any reason. If we cancel, except in the case of a force majeure event, we will offer alternate arrangements, and you may choose between a full refund of all monies paid or credit in that amount for any alternative trip. If the alternative trip is less costly than the canceled trip, we will refund you the difference. If the alternative trip is more expensive than the canceled trip, you will be required to pay the difference. The guest is responsible for any additional costs for air tickets or any other travel arrangements we do not make.

 

Recurring Payments

In some instances, Travelers may be required to make recurring, incremental payments toward the Trip Costs owed for a confirmed booking before beginning their trip (collectively, “Recurring Payments”). If applicable, more information on Recurring Payments will be made available via the Site and Services. Suppose Recurring Payments apply to a confirmed booking. In that case, the Traveler authorizes TRUE STRIVE, on behalf of the Trip Organizer, to collect the Total Fees, and the Traveler agrees that TRUE STRIVE will initiate payouts to the Trip Organizer in increments and at the frequency associated with the applicable Recurring Payments, identified on the Site and Services.

Rounding Off

TRUE STRIVE may, in its sole discretion, round up or round down amounts that are payable from or to Travelers or Trip Organizers to the nearest whole functional base unit in which the currency is denominated (e.g., to the nearest dollar, euro, or other supported currency); for example, Wetravel will round up an amount of $101.50 to $102.00, and $101.49 to $101.00.

Some currencies are denominated in large numbers. In those cases, TRUE STRIVE may determine the functional base unit to be 10, 100, or 1,000 of the currency; the corresponding examples for such currencies would be for TRUE STRIVE to round up an amount of 1,045 to 1,050 and 1,044 to 1,040, or 35,450 to 35,500 and 35,449 to 35,400, or 837,500 to 838,000 and 837,499 to 837,000.

 

Payment Processing Errors

TRUE STRIVE will take steps to rectify any payment processing errors that we become aware of. These steps may include crediting or debiting (as appropriate) the same payment method used for the original payout or payment by you so that you receive or pay the correct amount.

NO REFUND FOR UNUSED ARRANGEMENTS.  As True Strive’s prices are based on contract rates, there will not be any refund for any unused portion of your tour. If you cancel while the trip is in progress, there is no refund for the unused portion.

Taxes

Tax regulations may require Wetravel to collect appropriate tax information from our Trip Organizers, withhold taxes from payouts to Trip Organizers, or both. As a Trip Organizer, you are solely responsible for keeping the information in your tax forms current, complete, and accurate.

You, as a Trip Organizer, understand and agree that you are solely responsible for determining (i) your applicable Tax reporting requirements, and (ii) the Taxes that should be included, and for including Taxes to be collected or obligations relating to applicable Taxes in Listings. You are also solely responsible for remitting to the relevant authority any Taxes included or received by you. Wetravel cannot and does not offer Tax-related advice to any Members.

Where applicable, or based upon request from a Trip Organizer, Wetravel may issue a valid VAT invoice to such Trip Organizer.

You understand and acknowledge that appropriate governmental agencies, departments, or authorities (the “Tax Authority”) in the destination location of the Trip may require Taxes to be collected by Trip Organizers from Travelers on the amount paid for the right to consume and/or provide touristic services and other travel related activities, and to be remitted to the respective Tax Authority. In certain jurisdictions, Wetravel may decide in its sole discretion to facilitate the collection and remittance of

 

Taxes from Trip Organizers and/or Travelers on behalf of and instead of Trip Organizers if such tax jurisdiction asserts Wetravel or Trip Organizers have a tax collection and remittance obligation. Whether you are a Traveler of Trip Organizer, you agree that any claim or cause of action relating to collection and remittance of Taxes shall not extend to any supplier or vendor that may be used by TRUE STRIVE in connection with collection and remittance of Taxes if any. Travelers and Trip Organizers agree that we may seek additional amounts from you if the Taxes collected or remitted are insufficient to discharge your obligations to the Tax Authority fully and agree that your sole remedy for Taxes collected is a refund of Taxes collected by TRUE STRIVE from the applicable Tax Authority by applicable procedures set by that Tax Authority.

 

FORCE MAJEURE. True Strive assumes no liability for, any loss, damage, delay, or cancellation resulting in whole or in part from an Act of God or any other force majeure condition, including, without limitation: fire, volcanic eruption, hurricane, environmental pollution or contamination, inclement weather, earthquake, low or high water levels, flood, landslides, water or power shortages or failures, tropical storms or hurricanes, riots or civil commissions or disturbances, and any other acts of a similar nature, sabotage, cybersecurity issues and/or technology outages or disruptions, arrests, strikes or labor disruptions, restraint of rulers or peoples, expropriations, acts of terrorism, war, insurrection, quarantine restrictions, government health advisories, epidemics, pandemics, or warnings or alerts of any kind of nature, government seizures, refusal or cancellation or suspension or delay of any government authority or any license, permit or authorization, damages to its facilities or the travel Supplier and its facilities, or any other unforeseen circumstances or any other factors unforeseen by True Strive that impacts negatively on, or hampers, its ability to fulfill any of its contractual conditions. In the circumstances of force majeure, we will not be required to refund any money to you. However, if (and only if) we can recover any funds from our Suppliers (and we are under no obligation to), we will refund these to you without any charge by True Strive.

 

TRAVEL PROTECTION INSURANCE. It is the traveler’s responsibility to protect their purchases. For this reason, Travel Protection Coverage, including additional Cancel For Any Reason coverage, is required. Such a plan should cover Trip Cancellation or Interruption, Medical Expenses, Emergency Evacuation/Repatriation, and Baggage. Travel protection plans can help protect you in the event of loss of non-refundable trip deposits and payments that result from cancellation or trip interruption (due to a covered reason such as injury or illness before or during the trip). It also helps reimburse medical emergency costs (including costly medical evacuation and repatriation), missed connections, and baggage loss. Travel protection plans, including Cancel For Any Reason coverage, must be purchased in close conjunction with your travel purchase. True Strive requires all travelers to submit proof of their travel insurance policy, including Trip Cancellation coverage, within ten (10) days of submitting the initial deposit. Travel documents may not be released without receipt of proof of your travel insurance policy. The ten (10) day issuance of a policy from the date of deposit is used to establish a traveler’s pre-existing condition, should a claim be submitted. Any and all cancellation fees will not be accepted as part of your claim.

 

True Strive is not qualified to answer technical questions about travel insurance plans' benefits, exclusions, and conditions. True Strive cannot evaluate the adequacy of the prospective insured's existing insurance coverage. Call your insurer, insurance agent, or broker if you have any questions about your travel protection. 

 

Certain countries require foreign visitors to have valid medical insurance on entry. True Strive cannot be held responsible for denied entry if a traveler is unable to provide details to authorities of insurance or denial of entry for any reason. Declining to purchase an adequate travel protection plan could result in losing your travel costs and/or requiring more money to correct the situation. You also acknowledge that without this coverage, there may be no way to recoup any losses, costs, or expenses incurred. If you choose to travel without adequate coverage, we will not be liable for any of your losses, however they arise, for which trip protection plan coverage would otherwise have been available.   

 

DESTINATIONS AND DOCUMENTATION.  Travel to specific destinations may involve greater risk than others. True Strive urges travelers to remain informed on a daily basis about current news, as well as to review travel prohibitions, warnings, announcements, and advisories issued by the United States Government before booking travel to international destinations. Information on conditions in various countries and the risks associated with travel to particular international destinations can be found at https://travel.state.gov/content/travel.html and http://www.cdc.gov. In addition, you should consult with government websites to ensure that you are in compliance with all requirements for admittance into that country, including COVID-19 requirements, as well as understanding local laws that govern travel within a country, such as medical tests and tracking. 

 

A U.S. State Department travel advisory for travel to Vietnam is available at https://travel.state.gov/content/travel/en/traveladvisories/traveladvisories/vietnam-travel-advisory.html. Should you choose to travel to a country that has been issued a travel warning or advisory, True Strive will not be liable for damages or losses that result from travel to such destinations. 

 

Each traveler is responsible for obtaining and carrying a valid passport, visa(s), inoculations, and all other documents required by applicable government regulations. For up-to-date requirements, US citizens should visit www.travel.state.gov. When traveling domestically within the USA or internationally, the U.S. Transportation Security Administration (TSA) and U.S. Department of Homeland Security (DHS) advise that everyone carry at least two forms of acceptable identification in order to board a flight, found here http://www.tsa.gov/traveler-information/acceptable-ids. Air travelers with identification (ID) that does not meet the REAL ID ACT requirements will have to use alternate ID forms (passport, military ID, or permanent resident card) to pass TSA security checkpoints—even for domestic travel. Visas are required when they apply. You can find out if your international destination requires a visa at https://www.usa.gov/visas-citizens-traveling-abroad. Travelers voluntarily assume complete and sole responsibility for any and all risks and/or costs involved with failure to report any errors and/or omissions to documentation. True Strive strongly recommends that you take into account that certain countries will not admit a passenger if their passport expires within six (6) months of the date of entry. Many countries require a minimum number of blank pages in your passport book. Non-USA citizens may require additional documentation. Children and infants also require all such travel documents. Minors traveling with one parent and/or without both parents may be stopped and not admitted unless authenticated and verified consent forms are provided to the authorities. Please visit www.travel.state.gov or https://www.dhs.gov/real-id for the most updated requirements for travel documentation.

 

Certain countries restrict travelers with criminal convictions, even if expunged. Please inform us prior to booking with us if this applies to you and seek separate legal counsel to confirm your ability to travel to your desired destination. True Strive shall not be liable for any losses, expenses, or refunds to you or anyone in your group if you are denied access to a country or a Supplier due to a conviction.

 

Recommended inoculations for travel may change, and you should consult your practitioner for current recommendations before you depart. It is your responsibility to ensure that you meet all health entry requirements, obtain the recommended inoculations, take all recommended medication, and follow all medical advice in relation to your trip. Inoculation requirements can be found on the Center for Disease Control website at https://www.cdc.gov/

 

You acknowledge any failure to comply with these requirements strictly may result in denied boarding or an undue delay at an airport security checkpoint, causing the traveler to miss flight(s) and subsequent scheduled travel bookings trips. True Strive bears no responsibility for advising you and/or obtaining required travel documentation or any delays, damages, and/or losses, including missed portions of your vacation related to improper documentation or government decisions about entry.

 

INSECTICIDE NOTICE. Travelers are encouraged to check the list of countries that require airlines to treat the passenger cabin with insecticides prior to the flight or while on the aircraft on the U.S. Department of Transportation’s website, which is updated periodically: http://www.dot.gov/office-policy/aviation-policy/aircraft-disinsection-requirements.

 

NON-RESPONSIBILITY. True Strive and its Representatives use third-party Suppliers to arrange trips, transportation, sightseeing, lodging, and all other services related to this trip. True Strive is an independent contractor and is not a Representative of any of these Suppliers. True Strive does not own, manage, operate, supervise, or control any transportation, vehicle, airplane, hotel restaurant, or other entity that supplies services related to your trip. All Suppliers are independent contractors and are not Representatives of True Strive. All tickets, receipts, coupons, and vouchers are issued subject to the terms and conditions specified by each Supplier. By accepting the coupons, vouchers, and tickets or utilizing the services, all travelers agree that neither True Strive nor its Representatives are or may be liable for any loss, injury, or damage to any trip traveler or their belongings, or otherwise, in connection with any service supplied or not supplied resulting directly or indirectly from any occurrence beyond the control of True Strive. True Strive assumes no responsibility or liability for any delay, schedule change, loss, injury or damage, or loss of any traveler that may result from any act or omission on the part of others; True Strive assumes no responsibility or liability for personal property; and True Strive shall be relieved of any obligations under these Terms and Conditions in the event of any strike, labor dispute, act of God, or government, fire, war, whether declared or not, terrorism, insurrection, riot, theft, pilferage, epidemic, pandemic, illness, physical injury, quarantine, medical or customs or immigration regulation, delay, or cancellation. True Strive accepts no responsibility for lost or stolen items. True Strive reserves the right to refuse any traveler or potential traveler at its sole discretion.

 

ASSUMPTION OF RISK/WAIVER.  Travelers are aware that travel such area as a traveler is undertaking on the trip may involve inherent risks, some in remote regions of the world. Inherent risks include, but are not limited to, risk of injury or death from: motor and conveyance vehicle collisions, animals, roadway hazards, slips, and falls, criminal or terrorist acts, government actions, consumption of alcoholic beverages, tainted food, or non-potable water; exposure to the elements, including heat, cold, sun, water, and wind; your own negligence and/or the negligence of others, including tour guides, other travelers, True Strive and its Representatives; attack by or encounter with insects, reptiles, and/or animals; accidents or illness occurring in remote places where there are no available medical services; microbiological, chemical or physical hazards relating to the non-adherence to kitchen safety protocols and improper harvesting, processing, transporting, preparing, cooking, storing and serving of food and foodborne illnesses or allergic reactions resulting from said hazards, fatigue, chill, overheating, and/or dizziness; known or unknown medical conditions, physical excursion for which you are not prepared or other such accidents; the negligence or lack of adequate training of any third-party providers who seek to assist with medical or other help either before or after injuries have occurred; accident or illness without access to means of rapid evacuation or availability of medical supplies or services; and the adequacy of medical attention once provided.

 

Traveler understands the description of these risks is incomplete and that unknown or unanticipated risks may result in injury, illness, or death. To partake of the enjoyment and excitement of this trip, a traveler is willing to accept the risks and uncertainty involved as being an integral part of travel, including the risk of infection, illness, and death. Traveler hereby accepts and assumes full responsibility for any and all risks and agrees to and shall hold harmless and fully release True Strive from any and all claims associated with the trip, including any claims of third-party negligence and/or the negligence of True Strive and traveler hereby covenant not to sue True Strive for any such claims or join any lawsuit or action that is suing True Strive. These Terms and Conditions also bind your heirs, legal representatives, and assigns. The terms of this HOLD HARMLESS AND RELEASE OF ALL LIABILITY paragraph shall survive any termination or cancellation of these Terms and Conditions, whether by operation of law or otherwise. 

 

INDEMNIFICATION. Traveler agrees to and shall indemnify and hold harmless True Strive and its officers, directors, employees, and agents from any expenses, losses, liabilities, damages, judgments, settlements and costs (collectively, “damages”) involved with or incurred by True Strive (including, without limitation, reasonable attorneys’ fees and the advancement of same) with respect to any claims, lawsuits, arbitrations, or other causes of action, which result, directly or indirectly, from: (i) traveler’s breach or violation, or threatened breach or violation, of these Terms and Conditions; (ii) any of your negligent acts or omissions, or any damage caused by traveler while participating in the trip; (iii) any force majeure or inherent risk of travel; or (iv) claims brought by third parties in connection with any of the foregoing. The terms of this INDEMNIFICATION paragraph shall survive any termination or cancellation of these Terms and Conditions, whether by operation of law or otherwise.

 

YOUR BEHAVIOR. Each traveler on any trip planned by True Strive is expected to act responsibly and adhere to all behavior guidelines established by True Strive and our Suppliers. True Strive and all Suppliers reserve the right to remove you from any facility, hotel or resort property, trip location, or means of transportation if your health or your conduct appears to endanger yourself or others, disrupt the general well-being of other individuals on any element of your trip, or interferes with the operation or security of the places we visit. In any such case, there will be no refund.

 

When you book with True Strive, you accept responsibility for any damage or loss caused by you or your group. Full payment for any such damage or loss (reasonably estimated if not precisely known) must be paid directly at the time to the accommodation owner, manager, or other Supplier. You must indemnify us for the full amount of any claim (also including legal costs) made against us. We are not responsible for any costs incurred concerning a guest removed from a trip or any portion of a trip. You agree not to hold True Strive or any of its related entities liable for any actions taken under these Terms and Conditions. Baggage and personal effects are, at all times, the sole responsibility of the traveler.

 

You acknowledge and agree to follow and abide by any and all laws and regulations of any state and/or country you enter while participating in the trip. While all local and national laws and regulations are essential to follow, we strictly encourage you to be informed concerning drug use and/or possession in particular. There will be no tolerance for any use or possession of any drug, and your failure to strictly comply with this requirement will result in a breach of these Terms and Conditions. It may prevent you from continuing to participate. We require responsible alcohol consumption for your safety and for those around you. You will not be refunded if you are asked to leave a trip for inappropriate behavior, violence, or any other disruptive action.

 

For trips that include hands-on and/or demonstration-style cooking lessons, you will be required to adhere to any and all proper safety protocols as set forth by our Supplier’s kitchen staff to prevent any injuries relating to, but not limited to, exposure to open flames, high-temperature equipment and materials such as knives, etc., wet or unclean floors and maintain proper attire as instructed. We are not liable for any medical or other costs concerning injuries to or caused by you.

BAGGAGE FEES. Due to continual changes in airline baggage policies domestically and internationally, it is suggested that you check your airline's website for up-to-date fees and information. True Strive is NOT responsible for additional costs incurred for baggage or seating. 

 

RE-CONFIRM YOUR FLIGHT. True Strive advises you to personally re-confirm your flight schedule with the airline within 24 hours before departure in case of any last-minute changes or delays. Most airlines allow you to check in online 24 hours before departure

User Conduct

You understand and agree that you are solely responsible for compliance with any laws, rules, regulations, and Tax obligations that may apply to your use of the Site, Services, and Collective Content. In connection with your use of the Site, Services, and Collective Content, you may not, and you agree that you will not:

 

Violate any local, state, provincial, national, or other law or regulation or any order of a court, including, without limitation, zoning restrictions and Tax regulations;

use manual or automated software, devices, scripts, robots, or other means or processes to access, “scrape,” “crawl,” or “spider” any web pages or other services contained in the Site, Services, or Collective Content;

Use the Site, Services, or Collective Content for any commercial or other purposes that are not expressly permitted by these Terms;

Copy, store, or otherwise access any information contained on the Site, Service, or Collective Content for purposes not expressly permitted by these Terms;

Infringe the rights of any person or entity, including, without limitation, their intellectual property, privacy, publicity, or contractual rights;

Interfere with or damage our Site or Services, including, without limitation, through the use of viruses, cancel bots, Trojan horses, harmful code, flood pings, denial-of-service attacks, packet or IP spoofing, forged routing or electronic mail address information, or similar methods or technology;

Use our Site or Services to transmit, distribute, post,t or submit any information concerning any other person or entity, including, without limitation, photographs of others without their permission, personal contact information or credit, debit, calling card, or account numbers;

use our Site, Services, or Collective Content in connection with the distribution of unsolicited commercial email ("spam") or advertisement, "stalk" or harass any other user of our Site, Services, or Collective Content, or collect or store any personally identifiable information about any other user other than for purposes of transacting as a TRUE STRIVE Traveler of Trip Organizer;

Offer, as a Trip Organizer, any trip that you do not conduct, organize, or operate;

Register for more than one TRUE STRIVE Account or register for a TRUE STRIVE Account on behalf of an individual other than yourself;

Unless TRUE STRIVE explicitly permits otherwise, request or book a Trip if you will not be going on that Trip yourself;

contact a Trip Organizer for any purpose other than asking a question related to a Trip contact a Traveler for any purpose other than asking a question related to a booking or such Traveler’s use of the Site and Services;

recruit or otherwise solicit any Trip Organizer or other Member to join third-party services or websites that are competitive to TRUE STRIVE without TRUE STRIVE’s prior written approval;

Impersonate any person or entity, or falsify or otherwise misrepresent yourself or your affiliation with any person or entity;

Use automated scripts to collect information from or otherwise interact with the Site, Services, or Collective Content;

Use the Site, Services, or Collective Content to find a Trip Organizer or Traveler and then complete a booking of a Trip independent of the Site or Services to circumvent the obligation to pay any Service Fees related to TRUE SSTRIVE'sSTRIVE'sonof the Services or for any other reasons; as a Trip Organizer, submit any Listing with false or misleading price information, submit any Listing with a price that you do not intend to honor;

Post, upload, publish, submit, or transmit any Content that:

Infringes, misappropriates, or violates a third-party copyright, trademark, trade secret, moral rights, or other intellectual property rights, or rights of publicity or privacy;

Violates or encourages any conduct that would violate any applicable law or regulation or would give rise to civil liability;

is fraudulent, false, misleading, or deceptive;

is defamatory, obscene, pornographic, vulgar or offensive;

promotes discrimination, bigotry, racism, hatred, harassment, or harm against any individual or group;

Is violent or threatening or promotes violence or actions that are threatening to any other person; or

promotes illegal or harmful activities or substances;

Systematically retrieve data or other content from our Site or Services to create or compile, directly or indirectly, in single or multiple downloads, a collection, compilation, database, directory, or the like, whether by manual methods, through the use of bots, crawlers, or spiders, or otherwise;

use, display, mirror, or frame the Site, Services or Collective Content, or any individual element within the Site, Services or Collective Content, TRUE STRIVE’s name, any TRUE STRIVE trademark, logo, or other proprietary information, or the layout and design of any page or form contained on a page in the Site or Services, without TRUE STRIVE’s express written consent;

access, tamper with, or use non-public areas of the Site or Services, TRUE STRIVE’s computer systems, or the technical delivery systems of TRUE STRIVE’s providers;

attempt to probe, scan, or test the vulnerability of any TRUE STRIVE system or network or breach any security or authentication measures;

forge any TCP/IP packet header or any part of the header information in any email or newsgroup posting, or in any way use the Site, Services, or Collective Content to send altered, deceptive, or false source-identifying information;

attempt to decipher, decompile, disassemble, or reverse engineer any of the software used to provide the Site, Services, or Collective Content; or advocate, encourage, or assist any third party in doing any of the foregoing.

TRUE STRIVE has the right to investigate and prosecute violations of any of the above to the fullest extent of the law.

TRUE STRIVE may access, preserve, and disclose any of your information if we are required to do so by law or if we believe in good faith that it is reasonably necessary to respond to claims asserted against TRUE STRIVE or to comply with legal process (for example, subpoenas or warrants);

enforce or administer our agreements with users;

engage in fraud prevention, risk assessment, investigation, customer support, product development, and de-bugging purposes; or

protect the rights, property, or safety of TRUE STRIVE, its users, or members of the public.

You acknowledge that TRUE STRIVE has no obligation to monitor your access to or use of the Site, Services, or Collective Content or to review or edit any Member Content but has the right to do so to operate and improve the Site and Services (including without limitation for fraud prevention, risk assessment, investigation and customer support purposes), to ensure your compliance with these Terms, to comply with applicable law or the order or requirement of a court, administrative agency or other governmental body, to respond to content that it determines is otherwise objectionable or as outlined in these Terms.

 

TRUE STRIVE reserves the right, at any time and without prior notice, to remove or restrict access to any Collective Content that TRUE STRIVE, at its sole discretion, considers to be objectionable for any reason, in violation of these Terms, or otherwise harmful to the Site or Services.

HEALTH/PRE-EXISTING MEDICAL CONDITIONS/PERSONS WITH DISABILITIES. For the safety of our guests, True Strive reserves the right to request health information prior to travel and to exclude any participants it deems unfit for travel at its sole discretion.

The nature of many of the destinations we travel to means that, in some cases, they may be unsuitable for those who use a wheelchair or lack mobility. However, we will be delighted to discuss the feasibility of your participation in any of our trips. It is essential that you advise us before booking if you do have any disability or pre-existing medical condition that may affect your ability to do so or if you have any special requirements as a result of any disability or medical condition (including any which affect the booking process) so that we can assist you in considering the suitability of the arrangements and/or in making the booking. True Strive will communicate requests to suppliers but cannot be responsible if accommodations for the Americans with Disabilities Act (ADA) are unavailable. Any accommodations provided will be at the sole expense of the traveler requiring the accommodation. Please note that accommodations outside of the USA may not be in compliance with the Americans with Disabilities Act (ADA) and may not have wheelchair accessibility. Unfortunately, our Suppliers cannot offer additional assistance to travelers with limited mobility, and all such assistance will need to be provided by whomever the traveler is traveling with. Travelers with disabilities must notify True Strive at the time of booking of the status and the identity of their non-discounted, paid travel companion, who will be responsible for providing all necessary assistance. We request that you send your doctor a letter confirming your travel fitness.

If you are pregnant or expecting at or around the time of your planned travels, please inform us prior to booking. Some Suppliers will not permit travel past specific gestational periods for your safety and the safety of your child/ren. If you become pregnant after booking with us, please consult with a doctor and review the Supplier terms and conditions related to your booking to determine whether you will be permitted or prevented from traveling. Suppose you are denied boarding embarkation or access to a Supplier due to pregnancy. In that case, True Strive shall not be liable for any losses, expenses, or refunds resulting from such loss of access for you or anyone in your group.

Children are welcome on many of our tours, but an adult or guardian must always accompany and supervise any child(ren) under 18. True Strive reserves the right, at its sole discretion, to limit the number of travelers under 18 on our tours and to exclude children from specific tours with an age requirement. 

PHOTOGRAPHIC/VIDEO LIKENESS. Traveler hereby gives consent and grants to True Strive a royalty-free, perpetual, and irrevocable license to publish any photographs and/or videos of the trip or traveler in printed or electronic media without obtaining further consent and without compensation. Each Traveler releases True Strive and its Representatives from any liability in connection with any use of such photographs and/or video. Additionally, when you travel with us and share content including, without limitation, written content, images, or videos with us by tagging us on social media or sending the information to us by e-mail or other means, you provide us with a perpetual, royalty-free, worldwide, irrevocable license to use your content in any medium for any purpose.

CLASS ACTION WAIVER/LIMITATION OF DAMAGES/NOTICE OF CLAIM. You agree that you will only bring claims against True Strive in your individual capacity and not as a plaintiff or class member in any purported class action or representative proceeding. True Strive shall not, in any case, be liable for other than compensatory damages, and your payment of a deposit on a trip means that you agree to these conditions of sale and expressly waive any right to punitive damages. You understand and agree that no claims will be considered and that you will not bring suit against True Strive unless you have first provided a typewritten notice of claim to True Strive within 30 days after the trip or cancellation of the trip, further provided that you agree to file suit within one (1) year of the incident and you acknowledge that this expressly limits the applicable statute of limitations to one (1) year. Any claims not submitted and received within this time shall be deemed irrevocably waived and barred. Notwithstanding the foregoing, in no event shall True Strive’s liability to you (or any member of your traveling party, or your/their heirs, successors, and assigns) from any cause of action (whether in contract, tort, indemnity, equity, or otherwise), exceed the amounts paid to True Strive for the services True Strive performed and provided to you in connection with this Agreement, and this is your sole and exclusive remedy for a breach of this Agreement by True Strive.

GOVERNING LAW/VENUE/JURY WAIVER. These Terms and Conditions and all attachments hereto and the rights of the parties hereunder shall be governed by and construed in accordance with the laws of the State of Nevada, exclusive of conflict or choice of law rules. Any claims shall be brought in a court of competent jurisdiction in the State of Nevada. You agree that you will only bring claims against True Strive in your individual capacity and not as a plaintiff or class member in any purported class action or representative proceeding. True Strive shall not, in any case, be liable for other than compensatory damages, and your payment of a deposit on a trip means that you agree to these conditions of sale and expressly waive any right to punitive damages. 

ELECTRONIC COMMUNICATIONS. You have a committed team by your side every step of the way. From check-in to check-out, you will have direct access to the True Strive team so we can handle anything you may need assistance with remotely while on vacation with an add-on service(s). You can expect us to check in with you via email and/ or text message before, during, and after your trip to ensure everything runs smoothly. You consent to receive electronic communications and agree that all documents, notices, disclosures, and other communications that we provide to you electronically, via email, or through text satisfy any legal requirement that such communications be in writing. 

Disclaimers

IF YOU CHOOSE TO USE THE SITE, SERVICES, OR COLLECTIVE CONTENT, YOU DO SO AT YOUR SOLE RISK. YOU ACKNOWLEDGE AND AGREE THAT TRUE STRIVE DOES NOT HAVE AN OBLIGATION TO CONDUCT BACKGROUND CHECKS ON ANY MEMBER, INCLUDING, BUT NOT LIMITED TO, TRIP ORGANIZERS AND TRAVELERS, BUT MAY CONDUCT SUCH BACKGROUND CHECKS IN ITS SOLE DISCRETION. THE SITE, SERVICES AND COLLECTIVE CONTENT ARE PROVIDED “AS IS”, WITHOUT WARRANTY OF ANY KIND, EITHER EXPRESS OR IMPLIED. WITHOUT LIMITING THE FOREGOING, TRUE STRIVE EXPLICITLY DISCLAIMS ANY WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, QUIET ENJOYMENT OR NON-INFRINGEMENT, AND ANY WARRANTIES ARISING OUT OF COURSE OF DEALING OR USAGE OF TRADE. TRUE STRIVE MAKES NO WARRANTY THAT THE SITE, SERVICES, OR COLLECTIVE CONTENT, INCLUDING, BUT NOT LIMITED TO, THE LISTINGS OR ANY TRIPS, WILL MEET YOUR REQUIREMENTS OR BE AVAILABLE ON AN UNINTERRUPTED, SECURE, OR ERROR-FREE BASIS. TRUE STRIVE MAKES NO WARRANTY REGARDING THE QUALITY OF ANY LISTINGS, TRIPS, THE SERVICES OR COLLECTIVE CONTENT OR THE ACCURACY, TIMELINESS, TRUTHFULNESS, COMPLETENESS OR RELIABILITY OF ANY COLLECTIVE CONTENT OBTAINED THROUGH THE SITE OR SERVICES.

 

NO ADVICE OR INFORMATION, WHETHER ORAL OR WRITTEN, OBTAINED FROM TRUE STRIVE OR THROUGH THE SITE, SERVICES, OR COLLECTIVE CONTENT WILL CREATE ANY WARRANTY NOT EXPRESSLY MADE HEREIN.

YOU ARE SOLELY RESPONSIBLE FOR ALL OF YOUR COMMUNICATIONS AND INTERACTIONS WITH OTHER USERS OF THE SITE OR SERVICES AND WITH OTHER PERSONS WITH WHOM YOU COMMUNICATE OR INTERACT AS A RESULT OF YOUR USE OF THE SITE OR SERVICES, INCLUDING, BUT NOT LIMITED TO, ANY TRAVELERS OR TRIP ORGANIZERS. YOU UNDERSTAND THAT TRUE STRIVE DOES NOT MAKE ANY ATTEMPT TO VERIFY THE STATEMENTS OF USERS OF THE SITE OR SERVICES OR TO REVIEW OR VISIT ANY ACCOMMODATIONS. TRUE STRIVE MAKES NO REPRESENTATIONS OR WARRANTIES AS TO THE CONDUCT OF USERS OF THE SITE OR SERVICES OR THEIR COMPATIBILITY WITH ANY CURRENT OR FUTURE USERS OF THE SITE OR SERVICES. YOU AGREE TO TAKE REASONABLE PRECAUTIONS IN ALL COMMUNICATIONS AND INTERACTIONS WITH OTHER USERS OF THE SITE OR SERVICES AND WITH OTHER PERSONS WITH WHOM YOU COMMUNICATE OR INTERACT AS A RESULT OF YOUR USE OF THE SITE OR SERVICES, INCLUDING, BUT NOT LIMITED TO, TRAVELERS AND TRIP ORGANIZERS, PARTICULARLY IF YOU DECIDE TO MEET OFFLINE OR IN PERSON REGARDLESS OF WHETHER SUCH MEETINGS ARE ORGANIZED BY TRUE STRIVE. NOTWITHSTANDING TRUE STRIVE’S APPOINTMENT AS THE LIMITED PAYMENT COLLECTION AGENT OF THE TRIP ORGANIZER FOR THE PURPOSE OF ACCEPTING PAYMENTS FROM TRAVELERS ON BEHALF OF THE TRIP ORGANIZER, TRUE STRIVE EXPLICITLY DISCLAIMS ALL LIABILITY FOR ANY ACT OR OMISSION OF ANY TRAVELER OR OTHER THIRD PARTY.

Limitations of Liability

YOU ACKNOWLEDGE AND AGREE THAT, TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE ENTIRE RISK ARISING OUT OF YOUR ACCESS TO AND USE OF THE SITE, APPLICATION, SERVICES AND COLLECTIVE CONTENT, YOUR LISTING OR BOOKING OF ANY TRIPS VIA THE SITE, APPLICATION AND SERVICES, YOUR PARTICIPATION IN THE REFERRAL PROGRAM, AND ANY CONTACT YOU HAVE WITH OTHER USERS OF TRUE STRIVE WHETHER IN PERSON OR ONLINE REMAINS WITH YOU. NEITHER TRUE STRIVE NOR ANY OTHER PARTY INVOLVED IN CREATING, PRODUCING, OR DELIVERING THE SITE, APPLICATION, SERVICES, COLLECTIVE CONTENT OR THE REFERRAL PROGRAM WILL BE LIABLE FOR ANY INCIDENTAL, SPECIAL, EXEMPLARY OR CONSEQUENTIAL DAMAGES, INCLUDING LOST PROFITS, LOSS OF DATA OR LOSS OF GOODWILL, SERVICE INTERRUPTION, COMPUTER DAMAGE OR SYSTEM FAILURE OR THE COST OF SUBSTITUTE PRODUCTS OR SERVICES, OR FOR ANY DAMAGES FOR PERSONAL OR BODILY INJURY OR EMOTIONAL DISTRESS ARISING OUT OF OR IN CONNECTION WITH THESE TERMS, FROM THE USE OF OR INABILITY TO USE THE SITE, APPLICATION, SERVICES OR COLLECTIVE CONTENT, FROM ANY COMMUNICATIONS, INTERACTIONS OR MEETINGS WITH OTHER USERS OF THE SITE, APPLICATION, OR SERVICES OR OTHER PERSONS WITH WHOM YOU COMMUNICATE OR INTERACT AS A RESULT OF YOUR USE OF THE SITE, APPLICATION, SERVICES, OR YOUR PARTICIPATION IN THE REFERRAL PROGRAM OR FROM YOUR LISTING OR BOOKING OF ANY ACCOMMODATION VIA THE SITE, APPLICATION AND SERVICES, WHETHER BASED ON WARRANTY, CONTRACT, TORT (INCLUDING NEGLIGENCE), PRODUCT LIABILITY OR ANY OTHER LEGAL THEORY, AND WHETHER OR NOT WETRAVEL HAS BEEN INFORMED OF THE POSSIBILITY OF SUCH DAMAGE, EVEN IF A LIMITED REMEDY SET FORTH HEREIN IS FOUND TO HAVE FAILED OF ITS ESSENTIAL PURPOSE.
 

EXCEPT FOR OUR OBLIGATIONS TO PAY AMOUNTS TO APPLICABLE HOSTS PURSUANT TO THESE TERMS OR AN APPROVED PAYMENT REQUEST UNDER THE WETRAVEL HOST GUARANTEE, IN NO EVENT WILL TRUE STRIVE’S AGGREGATE LIABILITY ARISING OUT OF OR IN CONNECTION WITH THESE TERMS AND YOUR USE OF THE SITE, APPLICATION AND SERVICES INCLUDING, BUT NOT LIMITED TO, FROM YOUR LISTING OR BOOKING OF ANY ACCOMMODATION VIA THE SITE, APPLICATION AND SERVICES, OR FROM THE USE OF OR INABILITY TO USE THE SITE, APPLICATION, SERVICES, OR COLLECTIVE CONTENT OR YOUR PARTICIPATION IN THE REFERRAL PROGRAM AND IN CONNECTION WITH ANY ACCOMMODATION OR INTERACTIONS WITH ANY OTHER MEMBERS, EXCEED THE AMOUNTS YOU HAVE PAID OR OWE FOR BOOKINGS VIA THE SITE, APPLICATION AND SERVICES AS A GUEST IN THE TWELVE (12) MONTH PERIOD PRIOR TO THE EVENT GIVING RISE TO THE LIABILITY, OR IF YOU ARE A HOST, THE AMOUNTS PAID BY WETRAVEL TO YOU IN THE TWELVE (12) MONTH PERIOD PRIOR TO THE EVENT GIVING RISE TO THE LIABILITY, OR ONE HUNDRED U.S. DOLLARS (US$100), IF NO SUCH PAYMENTS HAVE BEEN MADE, AS APPLICABLE. THE LIMITATIONS OF DAMAGES SET FORTH ABOVE ARE FUNDAMENTAL ELEMENTS OF THE BASIS OF THE BARGAIN BETWEEN TRUE STRIVE AND YOU. SOME JURISDICTIONS DO NOT ALLOW THE EXCLUSION OR LIMITATION OF LIABILITY FOR CONSEQUENTIAL OR INCIDENTAL DAMAGES, SO THE ABOVE LIMITATION MAY NOT APPLY TO YOU.

Reporting Misconduct

If you travel with anyone whom you feel is acting or has misbehaved, including but not limited to anyone who (i) engages in offensive, violent, or sexually inappropriate behavior, (ii) you suspect of stealing from you, or (iii) engages in any other disturbing conduct, you should immediately report such person to the appropriate authorities and then to TRUE STRIVE by contacting us with your police station and report number at hr@truestrive.org. Your report will not obligate us to take any action beyond that required by law (if any) or cause us to incur any liability to you.

 

ENTIRE AGREEMENT & SEVERABILITY: These Terms and Conditions, including any other documents, itineraries, and invoices we provide you, constitute our entire agreement, and it supersedes all prior or contemporaneous communications and proposals, whether electronic, oral, or written, with respect to True Strive. Suppose any provision of these Terms and Conditions shall be unlawful, void, or for any reason unenforceable. In that case, that provision shall be deemed severable from these Terms and Conditions and shall not affect the validity and enforceability of any remaining provisions. Failure by us to exercise or enforce any right or provision of these legally binding Terms and Conditions shall not constitute a waiver of such right or provision. Any ambiguities in interpreting these Terms and Conditions shall not be construed against the drafting party. The provisions of these Terms and Conditions, which by their nature extend beyond termination or expiration of these Terms and Conditions (whether by operation of law or otherwise), shall survive the expiry or termination of these Terms and Conditions to the full extent necessary for their enforcement and for the protection of the party in whose favor they operate. These Terms and Conditions shall be written in, and all other communication under or in connection with these Terms and Conditions shall be in English. Any translation into any other language shall not be an official version thereof. If there is any conflict in the interpretation between the English version and such translation, the English version shall control.
